What is a will, and do I need one if my estate is modest?

A will is a legal document expressing how you wish your assets to be distributed after your passing, and who should care for minor children. Even smaller estates benefit from a will — without one, your assets are distributed under the Distribution Act 1958 (for non-Muslims) or Faraid principles (for Muslims), which may not reflect your personal wishes.

How long does the probate process take in Malaysia?

Timelines vary depending on the complexity of the estate and the court's schedule. A straightforward Grant of Probate through the High Court typically takes between six months and two years. Estates qualifying under the Small Estates (Distribution) Act may be handled more quickly through Amanah Raya Berhad. We keep you informed at every stage.

What happens if someone passes away without a will in Malaysia?

The estate is said to be intestate. For non-Muslims, assets are distributed according to the Distribution Act 1958. For Muslims, Faraid (Islamic inheritance law) applies. In both cases, the distribution may not match the deceased's intentions, and family members will need to apply for Letters of Administration before any assets can be transferred.

Can I set up a trust for my children's future?

Yes. Trusts are a thoughtful way to provide for children or dependants over time, rather than transferring assets outright. We advise on inter vivos trusts (established during your lifetime) and testamentary trusts (created through your will), and help you select appropriate trustees to carry out your intentions.

What assets can be included in a Malaysian will?

Most personal assets can be covered — property, bank accounts, investments, vehicles, jewellery, and personal belongings. Certain assets like EPF nominations, life insurance policies, and jointly held property operate differently and we will explain how each interacts with your will during our consultation.
